Rape trial for ex-Colts linebacker McNary set to begin
INDIANAPOLIS -- The trial of former Indianapolis Colts linebacker Josh McNary, who is accused in the rape of a woman in December, is scheduled to begin Monday.
McNary is charged with rape, criminal confinement and battery. The trial is expected to take about four days.
According to a probable cause affidavit, McNary, 27, was arrested in January after a 29-year-old woman said she was attacked in the early morning hours of Dec. 1.
According to court records, the woman said she kissed the man but that he raped her after she resisted his further advances and told him to stop. Records also indicate that police tracked information from a cellphone that the woman says she took from the man's apartment and determined the man was McNary, a West Point graduate who had spent two seasons with the Colts.
According to the Indianapolis Star, the woman told detectives she scratched her attacker, and when they interviewed McNary, they noticed he had scratches and abrasions on his neck, abdomen, shoulder and back.
McNary has pleaded not guilty and, according to the Indianapolis Star, his attorney will likely argue that the sex was consensual.
His arrest came amid a flurry of stories about domestic abuse incidents involving National Football League players.
The Colts placed McNary on a list of players ineligible to practice or attend games after his arrest. His contract expired two months later.
