Clemens to judge: Dismiss perjury case
Former major league pitching star Roger Clemens is asking a judge to punish prosecutors for their ''egregious error'' in his perjury trial by dismissing the case.
Clemens filed arguments in Washington federal court Friday evening against prosecutors' argument that they made a simple mistake in showing jurors inadmissible evidence and should be given another chance to convict him. Clemens is accused of lying under oath when he told congressional investigators he never used performance-enhancing drugs.
The Clemens defense team said prosecutors' apology for the error in a court filing last week raises more questions than answers. They said even if prosecutors made a simple oversight in failing to redact their exhibits in the rush of other trial matters, it doesn't explain why they showed the inadmissible material to the jury.
