Is Kalshi Legal in Texas? October 2026 Legal Status and How to Trade

Published Oct. 29, 2026 2:11 p.m. ET

Is Kalshi legal in Texas? Yes, Kalshi is legal and available in Texas because it operates as a Designated Contract Market regulated by the federal Commodity Futures Trading Commission (CFTC), which places it outside Texas gambling law. Texas has one of the strictest gambling constitutions in the country and no legal online sportsbooks, so Kalshi has become the main way Texans can take a position on the Cowboys, the Longhorns, or the Texas Senate race.

Is Kalshi Legal in Texas? Quick Answer

Kalshi is legal in Texas. The platform accepts sign-ups from Texas residents, no Texas court or regulator has restricted it, and Texans aged 18 and older can create an account, deposit, and trade event contracts on sports, politics, economics, weather, and culture with no category restrictions.

Texas is one of the cleaner states for Kalshi right now. Unlike California, Nevada, or Michigan, Texas has no lawsuit, injunction, or tribal challenge targeting the platform. The pressure in Texas is legislative rather than legal: Lt. Gov. Dan Patrick has directed the Texas Senate to study closing what he calls gambling loopholes, and the issue is expected to surface in the 2027 legislative session.

Why Kalshi Is Legal in Texas When Sportsbooks Are Not

Texas bans most forms of gambling under Article III, Section 47 of the state constitution and Chapter 47 of the Texas Penal Code. Legalizing sports betting would require a constitutional amendment approved by two thirds of both chambers and a statewide vote. The House passed such an amendment in 2023, but it died in the Senate, and Lt. Gov. Patrick has said repeatedly that the votes are not there.

Kalshi does not need any of that. The CFTC designated KalshiEX LLC as a contract market on November 4, 2020, which allows it to list event contracts under the federal Commodity Exchange Act. Kalshi's position is that federal commodities law governs its products and that states cannot ban a product the federal government has authorized. It does not take bets against customers and does not set odds; it matches users who trade against each other.

Because Kalshi is not a sportsbook under Texas law, it has operated in the state without a Texas license since launch, and it added sports event contracts in January 2025. For a comparison of Kalshi with every other platform Texans can access, see our guide to the best prediction markets.

Kalshi Texas Legal Status: What Lawmakers and Regulators Are Doing

Texas has not sued Kalshi, and the Texas Attorney General's office has not opened an enforcement action. The activity in Texas is coming from the Legislature and from advocacy groups, and it is worth understanding because it could shape what happens in 2027. Here is the timeline writers should reference, most recent first.

  • Fall 2026: Texas election markets are drawing national attention. Kalshi's Texas Senate winner market passed $30 million in trading volume ahead of the November election, the highest volume Senate race on the platform this cycle, and local outlets have reported that lawmakers are weighing new oversight measures.
  • September 15, 2026: The Texas Senate State Affairs Committee held a public hearing on its Closing Gambling Loopholes interim charge and heard testimony from a Kalshi legal and enforcement representative. The House State Affairs Committee heard separate testimony the same day on the structure and regulation of prediction markets and event contracts.
  • July 2026: The Texas Medical Association called for tighter prediction market safeguards, including a possible 21+ age minimum and advertising restrictions, citing gambling related harm among young adults.
  • April 2026: Kalshi fined and suspended Ezekiel Enriquez, a Republican candidate in Texas' 21st Congressional District, after he traded on his own race. Enriquez accepted a five year platform ban and a $784.20 fine after Kalshi's surveillance team flagged the trades.
  • March 2026: Lt. Gov. Dan Patrick directed Texas senators to examine ways to close gambling loopholes tied to online prediction markets, including sports and election contracts. This is an interim charge, which means it produces a study and recommendations, not a law.
  • 2023 session: The Texas House passed a sports betting constitutional amendment (HJR 102) but the Senate never took it up. The 2025 session produced no movement on sports betting.

Will Texas Ban Kalshi?

Not before 2027, and probably not easily even then. The Texas Legislature meets in regular session only in odd numbered years, so the earliest any prediction market bill could pass is the session that begins in January 2027. Lt. Gov. Patrick controls the Senate agenda and opposes gambling expansion, but restricting a federally regulated exchange is a different legal question than refusing to legalize sportsbooks.

Any Texas restriction would also run into the same federal preemption fight playing out elsewhere. The Third Circuit sided with Kalshi against New Jersey in April 2026, while the Ninth Circuit (Nevada) and Sixth Circuit (Ohio and Tennessee) sided with the states in August and September 2026. Three petitions asking the U.S. Supreme Court to resolve the split are pending. Texas sits in the Fifth Circuit, which has not ruled on the issue, so a Texas enforcement action would start from a blank slate.

What Is Happening in Other States

Texans should understand the national picture because it shapes how Kalshi behaves. Kalshi is fully unavailable in Nevada, sports contracts are geofenced in Michigan under a September 2026 preliminary injunction, and Washington access is restricted by court order. New York sued Kalshi in July 2026 seeking roughly $36 billion in damages, and Utah won a ruling in August 2026 allowing it to enforce its anti-gambling laws against prediction markets.

None of those actions apply in Texas. Kalshi's own filings note that state restrictions could push users toward offshore platforms, an argument it made to Texas lawmakers at the September hearing.

Kalshi Texas Sports Markets

Sports is the biggest draw for Texans because there is no legal sportsbook in the state. Kalshi lists game markets, season futures, and player stat markets across the NFL, NBA, MLB, NHL, and college football.

  • NFL: Cowboys and Texans game winners, point totals, season win totals, division futures, and Super Bowl futures.
  • NBA: Mavericks, Rockets, and Spurs game markets plus championship and MVP futures.
  • MLB: Rangers and Astros game and postseason markets.
  • NHL: Dallas Stars game markets and Stanley Cup futures.
  • College football: Texas, Texas A&M, TCU, Baylor, Texas Tech, SMU, and Houston game markets and College Football Playoff futures.
  • Soccer: FC Dallas, Austin FC, and Houston Dynamo markets when listed, plus World Cup 2026 markets for the matches hosted in Dallas and Houston.
  • Player markets: Kalshi offers ladder markets that scale payouts with a player's final stat line and Slingshot markets with steeper payouts near the market maximum.

Kalshi Texas Politics Markets

Texas is the most traded political market in the country right now. Kalshi's Texas Senate winner market between Democrat James Talarico and Republican Attorney General Ken Paxton passed $30 million in volume ahead of the November 2026 election, and the platform also lists the Texas governor race, Lt. Gov. race, Railroad Commissioner race, and even the Harris County Judge race.

Remember that these prices are not polls. They reflect what traders are willing to pay, and they can move sharply on news. Kalshi also enforces insider trading rules, as the Enriquez case showed, and may ask for employment details before letting you trade certain political markets.

Economics, Weather, and Culture Markets

Economic contracts cover inflation prints, Fed rate decisions, jobs reports, and gas prices, including a Texas specific gas price market. Weather contracts cover daily high temperatures in Dallas, Houston, Austin, and San Antonio, rainfall totals, and Gulf Coast hurricane landfalls. Culture markets cover award shows, box office results, and streaming charts, including the Academy of Country Music Awards held in Frisco.

Kalshi vs Sports Betting in Texas

A sportsbook sets the odds and takes the other side of your bet. Kalshi hosts a market where you trade against other users, prices move with supply and demand, and you can sell a position before the event ends. The result feels similar when you are trading a Cowboys game, but the structure, regulation, and tax treatment are different.

Kalshi does not replace a sportsbook. There are fewer live markets, no teasers, and a thinner player prop menu. Texans who drive to Louisiana, Arkansas, or Colorado to bet can compare the options in our guides to the best betting apps and sportsbook promos.

Kalshi Taxes in Texas

Kalshi trading is generally reported as exchange activity rather than gambling winnings, so most users receive a Form 1099-B instead of a W-2G. The IRS has not issued specific guidance on event contracts, so the federal treatment is unsettled.

Texas has no state income tax, which makes Kalshi profits simpler for Texans than for traders in most other states. Federal tax still applies. Keep records of every deposit, trade, fee, and withdrawal, and consult a tax professional if you trade regularly. This article is not tax advice.

Other Prediction Markets Available in Texas

Kalshi is the largest prediction market operating in Texas, but every CFTC regulated platform below also accepts Texas residents and faces the same legal landscape.

  • Polymarket: Kalshi's biggest rival, available in the U.S. through the Polymarket US app.
  • DraftKings Predictions: DraftKings' prediction market product, which gives Texans access to a DraftKings branded app for the first time.
  • Novig: a sports focused exchange with commission free pre-game trades. Minimum age 21.
  • ProphetX: a sports exchange designated by the CFTC in June 2026.
  • OG Predictive: Crypto.com's prediction market, run through the North American Derivatives Exchange.
  • Plus500: a broker that resells Kalshi's contracts through Plus500 Futures rather than running its own exchange.

Is Kalshi Legal in Texas FAQs

Do I need a Kalshi promo code in Texas?

No, you can sign up without a code, but you will miss the welcome offer. Enter promo code FOXSPORTS55 at registration to Trade $25, Get $55 in Trading Credit after completing $25 in qualifying trades.

Is Kalshi legal in Texas?

Yes. Kalshi is legal and available in Texas because it operates as a Designated Contract Market regulated by the federal CFTC. No Texas court, regulator, or law currently restricts it.

Can I trade sports on Kalshi in Texas?

Yes. Texas has no restrictions on any Kalshi market category, so Texans can trade sports event contracts on the Cowboys, Texans, Longhorns, Aggies, and every other team Kalshi lists.

Why is Kalshi legal in Texas if sports betting is not?

Kalshi is regulated as a financial exchange under federal commodities law, not as a sportsbook under the Texas Penal Code. Sportsbooks would need a constitutional amendment that the Legislature has not passed. Kalshi argues federal law preempts state gambling rules, a position courts in other circuits are still testing.

Is Kalshi considered gambling in Texas?

Kalshi's position is that its contracts are federally regulated derivatives, not gambling. Lt. Gov. Dan Patrick and the Texas Medical Association have argued that sports and election contracts function like gambling, and the Legislature is studying the question ahead of the 2027 session. No Texas authority has made a binding determination.

How old do you have to be to use Kalshi in Texas?

Kalshi's minimum age is 18 in Texas. The Texas Medical Association has pushed for a 21+ minimum, but no such rule exists today.

What happens to my Kalshi account if Texas bans prediction markets?

If Texas passed a restriction, Kalshi would most likely geofence the affected categories and switch Texas accounts to withdrawal only for those markets, as it has done in other states. Existing positions would either be settled early at fair value or given a window to close. You would still be able to withdraw your funds.

Is Kalshi legit?

Yes. Kalshi has been a CFTC designated contract market since November 2020, which means it is subject to the same federal oversight as commodity and futures exchanges, including customer fund segregation, surveillance for insider trading, and identity verification on every account. It has paid out on settled contracts to Texans without issue since launch. For a full look at fees, deposit methods, and the welcome offer, read our Kalshi promo code review.

Does Kalshi pay out in Texas?

Yes. Winning contracts settle at $1 each and the funds land in your Kalshi balance immediately. Texans can withdraw to a linked bank account by ACH for free, usually within one to three business days, or by wire for larger amounts. Trading credit from the welcome offer cannot be withdrawn, but profit earned with it can be once you have traded an amount equal to the credit.

Is Polymarket legal in Texas too?

Yes. Polymarket US operates under the same CFTC framework and has the same legal status in Texas as Kalshi.
