Is Kalshi Legal in California? October 2026 Legal Status and How to Trade

Published Oct. 29, 2026 1:20 p.m. ET

Is Kalshi legal in California? Yes, Kalshi is legal and available in California because it operates as a Designated Contract Market regulated by the federal Commodity Futures Trading Commission (CFTC), not as a California licensed sportsbook. That distinction matters in a state where online sports betting is still not legal, and it is also why Kalshi's sports contracts are the subject of an active court fight involving three California tribes.

Is Kalshi Legal in California? Quick Answer

Kalshi is legal in California. The platform accepts sign-ups from California residents, the state has taken no enforcement action against it, and Californians aged 18 and older can create an account, deposit, and trade event contracts on sports, politics, economics, weather, and culture.

The honest caveat is that the sports side of the platform is under active litigation. Kalshi has voluntarily disabled its markets on the lands of three California tribes following a September 2026 Ninth Circuit ruling, and the broader question of whether states can regulate sports event contracts is heading toward the U.S. Supreme Court. None of that blocks Californians statewide today.

Why Kalshi Is Legal in California When Sportsbooks Are Not

California has one of the most restrictive sports betting environments in the country. Online sportsbooks like FanDuel and DraftKings cannot operate in the state because California has never passed a sports betting law, and tribal gaming compacts give California tribes an effective veto over commercial gambling expansion.

Voters made that clear in November 2022, when both sports betting ballot measures failed. Proposition 26 would have allowed in-person betting at tribal casinos and racetracks, and Proposition 27 would have allowed online sports betting. Both lost by wide margins, and no new ballot initiative is expected before 2028 at the earliest.

Kalshi sits outside that framework entirely. The CFTC designated KalshiEX LLC as a contract market on November 4, 2020, which allows it to list event contracts under the federal Commodity Exchange Act.

Kalshi's legal position is that federal commodities law covers its contracts and that a state cannot ban a product the federal government has authorized. Because it does not take bets against customers and instead matches users trading against each other, it does not need a California gambling license to operate.

Kalshi began offering sports event contracts in January 2025, and sports is now the most popular category for California users. If you want to understand how prediction markets compare to the sportsbooks available in other states, our guide to the best prediction markets breaks down every major platform.

Kalshi California Legal Challenges and Court Rulings

California has not sued Kalshi or ordered it to stop operating. Most of the legal pressure on Kalshi in California has come from tribal governments and from the Ninth Circuit Court of Appeals, which covers California along with Nevada and seven other western states. Here is the full timeline writers should reference, with the most recent events first.

  • Early October 2026: Kalshi asked the full Sixth Circuit to rehear its Ohio and Tennessee cases after a three judge panel ruled against it.
  • September 25, 2026: The Sixth Circuit ruled 3-0 that Kalshi's sports event contracts do not meet the federal definition of a swap and that the Commodity Exchange Act does not preempt Ohio or Tennessee gambling law. This ruling does not bind California courts but deepens the circuit split.
  • September 24, 2026: Kalshi told a federal court it had voluntarily disabled its prediction markets on the lands of the three California tribes involved in the Blue Lake Rancheria case.
  • September 16, 2026: The Ninth Circuit ruled in Blue Lake Rancheria v. Kalshi that two California tribes were likely to succeed on their claim that Kalshi sports contracts entered from tribal lands violate the Indian Gaming Regulatory Act. The case was sent back to the district court. The ruling did not impose a statewide ban.
  • September 2 to 11, 2026: New Jersey, Robinhood, and Crypto.com's exchange filed three separate petitions asking the U.S. Supreme Court to decide whether states can regulate sports prediction markets (dockets 26-299, 26-338, and 26-344). None has been granted yet.
  • September 9, 2026: Kalshi asked the full Ninth Circuit to rehear the Nevada case en banc. No decision has been issued.
  • August 28, 2026: The Ninth Circuit ruled 3-0 for Nevada regulators in KalshiEX v. Assad, finding that Kalshi had not shown federal law likely overrides Nevada gaming rules for sports contracts. Because the Ninth Circuit covers California, this ruling binds California's federal courts.
  • June 12, 2026: California Attorney General Rob Bonta joined a bipartisan coalition of 37 attorneys general backing Ohio's authority to enforce its gambling laws against Kalshi in the Sixth Circuit.
  • June 10, 2026: The CFTC proposed a new framework for sports and other event contracts. The proposal is not final.
  • April 6, 2026: The Third Circuit sided with Kalshi 2-1 against New Jersey, creating the circuit split that is now before the Supreme Court.
  • March 27, 2026: Governor Gavin Newsom signed an executive order barring state officials from using nonpublic government information to profit on prediction markets. The order regulates officials, not the platforms.
  • November 10, 2025: A federal judge in the Northern District of California denied the tribes' request for a preliminary injunction, allowing Kalshi to keep operating on tribal lands while the case proceeded. This was partly reversed in September 2026.
  • July 22, 2025: Blue Lake Rancheria, Chicken Ranch Rancheria of Me-Wuk Indians, and Picayune Rancheria of the Chukchansi Indians sued Kalshi and Robinhood in federal court, arguing sports event contracts constitute unlawful Class III gaming under the Indian Gaming Regulatory Act.

What the California Tribal Lands Ruling Means for You

The Blue Lake Rancheria ruling is narrow in practical terms. It applies to contracts entered from the lands of the tribes who sued, not to the state as a whole. Kalshi responded by geofencing those specific tribal lands, so if you are physically located on one of them, Kalshi markets will not load. Everywhere else in California, the app works normally.

The ruling matters more as a signal. It is the first appellate decision to find that Kalshi's sports contracts likely violate federal Indian gaming law, and California's other tribal nations are watching closely. More tribes could file similar suits, which would expand the geofenced areas.

What the Ninth Circuit Nevada Ruling Means for California

California is one of nine states whose federal courts follow the Ninth Circuit. The August 28, 2026 ruling in KalshiEX v. Assad found that Kalshi's sports event contracts are likely not swaps under federal law, which means Nevada can regulate them as gambling. That same reasoning would apply if California ever brought an enforcement action.

California has not done so. Attorney General Bonta has signaled where the state stands by joining the 37-state brief in Ohio, but joining a brief is not the same as suing. Until California files its own action or passes a law targeting prediction markets, Kalshi remains available statewide.

Could Kalshi Be Banned in California?

Three things could change Kalshi's status in California.

First, the U.S. Supreme Court could take one of the three pending petitions and rule that states can regulate sports contracts, which would apply nationwide. The earliest the Court could decide whether to hear the cases is late 2026.

Second, the Ninth Circuit could grant or deny Kalshi's en banc rehearing request.

Third, California itself could sue or legislate, as New York, Michigan, and Nevada have done.

Even in a worst case, the most likely outcome is that sports contracts become unavailable in California while political, economic, weather, and culture markets continue. That is what happened in Michigan, where a September 2026 injunction requires Kalshi to geofence sports contracts but leaves the rest of the platform live.

What Can You Trade on Kalshi in California?

Kalshi lists hundreds of markets at any given time, and California traders have access to all of them outside the geofenced tribal lands. Every market works the same way: you buy a Yes or No contract priced between $0.01 and $0.99, and if your side is correct at settlement, each contract pays $1.

Kalshi California Sports Markets

Sports is the most active category for Californians because there is no legal sportsbook alternative. Kalshi lists game markets, season futures, and player stat markets across the NFL, NBA, MLB, NHL, and college football.

  • NFL: Rams, Chargers, and 49ers game winners, point totals, season win totals, and Super Bowl futures.
  • NBA: Lakers, Warriors, Clippers, and Kings game markets plus championship and MVP futures.
  • MLB: Dodgers, Giants, Padres, Angels, and Athletics game and postseason markets.
  • NHL: Kings, Ducks, and Sharks game markets and Stanley Cup futures.
  • College football: USC, UCLA, Cal, and Stanford game markets and College Football Playoff futures.
  • Player markets: Kalshi offers ladder markets that scale payouts with a player's final stat line and Slingshot markets with steeper payouts near the market maximum.

Kalshi California Politics Markets

California is a major political market because of its size and the number of competitive races it produces. Kalshi's California governor market has traded more than $60 million in volume during the 2026 cycle, and the platform also lists markets on statewide offices, congressional races, and ballot measures.

Two California specific developments are worth knowing. Governor Newsom's March 2026 executive order bans state officials from trading on nonpublic information, and CalMatters reported in June 2026 that Kalshi donated to Xavier Becerra's gubernatorial campaign while hosting a market on the race. Neither affects your ability to trade, but both show that political markets are drawing scrutiny in Sacramento.

Economics, Weather, and Culture Markets

Kalshi's non-sports markets are where it feels least like a sportsbook. Economic contracts cover inflation prints, Fed rate decisions, jobs reports, and gas prices. Weather contracts cover daily high temperatures in Los Angeles and San Francisco, rainfall, and heat waves. Culture markets cover the Oscars, Grammys, box office results, and streaming charts, many of which are decided in California.

One category to watch: California Senators Adam Schiff and Alex Padilla joined other senators in 2026 urging the CFTC to rein in wildfire related prediction markets. Kalshi has not removed those markets, but they are politically sensitive in the state.

Kalshi vs Sports Betting in California

The simplest way to understand the difference is that a sportsbook sets the odds and takes the other side of your bet, while Kalshi hosts a market where you trade against other users. Prices move with supply and demand rather than being set by a bookmaker, and you can sell a position before the event ends.

Kalshi does not offer the full menu of a sportsbook. There are no live in-play bets on every game, no teasers, and far fewer player props. Californians who want that experience will need to wait for state legalization or travel to a legal state. Our guides to the best betting apps and sportsbook promos cover the options available in legal states.

Kalshi Taxes in California

Kalshi trading is generally reported as exchange activity rather than gambling winnings, so most users receive a Form 1099-B for the year instead of a W-2G. The IRS has not issued specific guidance on how event contracts should be classified, so federal treatment is unsettled.

California taxes personal income at rates from 1 percent to 13.3 percent, and Kalshi profits are taxable income in the state. Keep records of every deposit, trade, fee, and withdrawal, and consult a California tax professional if you trade regularly. This article is not tax advice.

Other Prediction Markets Available in California

Kalshi is the largest prediction market operating in California, but it is not the only one. Every CFTC regulated platform below accepts California residents and faces the same legal landscape.

  • Polymarket: Kalshi's biggest rival, available in the U.S. through the Polymarket US app.
  • DraftKings Predictions: DraftKings' prediction market product, which gives Californians access to a DraftKings branded app for the first time.
  • Novig: a sports focused exchange with commission free pre-game trades. Minimum age 21.
  • ProphetX: a sports exchange designated by the CFTC in June 2026.
  • OG Predictive: Crypto.com's prediction market, run through the North American Derivatives Exchange.
  • Plus500: a broker that resells Kalshi's contracts through Plus500 Futures rather than running its own exchange.

Is Kalshi Legal in California FAQs

Do I need a Kalshi promo code in California?

No, you can sign up without a code, but you will miss the welcome offer. Enter promo code FOXSPORTS55 at registration to Trade $25, Get $55 in Trading Credit after completing $25 in qualifying trades.

Is Kalshi legal in California?

Yes. Kalshi is legal and available in California because it operates as a Designated Contract Market regulated by the federal CFTC. California has not taken enforcement action against it, though its sports contracts are the subject of ongoing litigation.

Can I trade sports on Kalshi in California?

Yes. California residents can trade sports event contracts on Kalshi everywhere in the state except the lands of the three tribes involved in the Blue Lake Rancheria case, where Kalshi has disabled its markets.

Why is Kalshi legal in California if sports betting is not?

Kalshi is regulated as a financial exchange under federal commodities law, not as a sportsbook under California gambling law. Sportsbooks need a state license that California has never created. Kalshi argues federal law preempts state gambling rules, a position that courts are still testing.

Is Kalshi considered gambling in California?

Kalshi's position is that its contracts are federally regulated derivatives, not gambling. Three California tribes, Attorney General Rob Bonta, and the Ninth Circuit have taken the opposite view on sports contracts at various stages. The question has not been finally decided.

How old do you have to be to use Kalshi in California?

Kalshi's minimum age is 18 in California, compared to 21 for most online sportsbooks in legal states. You must also pass identity verification and have a U.S. residential address.

What happens to my Kalshi account if California bans sports contracts?

If California restricts sports contracts, Kalshi would most likely geofence that category while keeping political, economic, weather, and culture markets live, as it did in Michigan. Existing sports positions would either be settled early at fair value or given a window to close. You would still be able to withdraw your funds.

Is Kalshi legit?

Yes. Kalshi has been a CFTC designated contract market since November 2020, which means it is subject to the same federal oversight as commodity and futures exchanges, including customer fund segregation, surveillance for insider trading, and identity verification on every account. It has paid out on settled contracts to Californians without issue since launch. For a full look at fees, deposit methods, and the welcome offer, read our Kalshi promo code review.

Does Kalshi pay out in California?

Yes. Winning contracts settle at $1 each and the funds land in your Kalshi balance immediately. Californians can withdraw to a linked bank account by ACH for free, usually within one to three business days, or by wire for larger amounts. Trading credit from the welcome offer cannot be withdrawn, but profit earned with it can be once you have traded an amount equal to the credit.

Is Polymarket legal in California too?

Yes. Polymarket US operates under the same CFTC framework and has the same legal status in California as Kalshi. It is available through the Polymarket US iPhone app. For more information on Polymarket, visit our Polymarket promo code page or see our breakdown of Polymarket vs Kalshi.
