Witnesses back Avery's side of story
New York Rangers winger Sean Avery will not face any charges following his recent arrest for battery on a cop who attempted to break up a party at the hockey star's Hollywood Hills home, TMZ reported Thursday.
Police responded to a neighbor's noise complaint at around 1:00am local time Aug. 5. Avery was accused at the time of shoving the officer after answering the door, and slamming the door shut, before eventually cooperating with the authorities.
A law enforcement source told TMZ that a further investigation found the officer was never pushed.
"We're told the officer who made the battery report did so after his foot was caught in Avery's front door," the source said, adding that "multiple witnesses have corroborated the story."
The source added, "No criminal charges of any kind will be filed against Sean Avery stemming from his Aug. 5 arrest for battery on a police officer."
Avery could expect an "informal meeting with the LA city attorney," who will close the case without prosecution, the source said.
The 31-year-old Canada native became known more for his off-the-ice antics in recent years, while on the ice, he has earned the reputation as one of the NHL's biggest instigators.
Avery earned a six-game suspension from the league in December 2008 for his infamous "sloppy seconds" comment toward then-Calgary Flames defenseman Dion Phaneuf, who is dating Avery's ex, actor Elisha Cuthbert.
