Ex-Tulsa guard Pat Swilling won't face sexual assault charge

Prosecutors say charges will not be filed against former University of Tulsa guard Pat Swilling Jr., who was accused of sexual assault.

Tulsa County District Attorney Tim Harris said Tuesday that ''our ability to secure a jury trial conviction and punishment is not supported by evidence beyond a reasonable doubt.''

Swilling was suspended in February and did not play again after the allegation was levied against him. The university cleared Swilling earlier this month of any violations of the student code of conduct.

Swilling averaged 8.6 points, 2.0 rebounds and 1.2 assists per game for the Golden Hurricane. He transferred to Tulsa after starting his college career at St. Joseph's. Swilling's father, Pat, is a former All-Pro NFL linebacker.
