Appearance release for Angels photos and videos with FOX Sports West
1. In consideration of the opportunity afforded me to have my video submission (the "Submission") incorporated into the production of Fox Sports West, Inc.'s ("Producer") Los Angeles Angels telecasts (including pre- and/or post-game programming) on Fox Sports West (the "Program," my appearance, an "Appearance"), and for good and valuable consideration, the receipt and sufficiency of which I hereby acknowledge, I grant to Producer the rights set forth below.
2. Producer its successors, assignees, licensees and affiliates have the irrevocable and perpetual right, but not the obligation, to use as Producer desires, all still and motion pictures and recordings of me or my voice contained within the Submission and/or during my Appearance, including the right to use my name, voice, likeness and biographical information in the Program and other Fox Sports West programming and in connection with advertising, publicizing, promoting, exhibiting, distributing and exploiting such, in whole or in part, in any manner whatsoever, by any and all means, media, devices, processes and technology now or hereafter known or devised, including, without limitation, the internet, wireless applications, interactive television, video on demand and any other media or technology through which Producer may distribute its content to end users, whether now existing or hereafter developed in perpetuity throughout the universe, and acknowledge that such stills, motion pictures and recording are the sole and exclusive property of Producer. I agree that you may create and include in the Program and/or other productions such actual or fictional incidents, scenes, situations, dialogue, events, characters, names, biographical information and other material as you may, in your sole discretion, consider proper or necessary and you are free to edit, change and dub my Appearance with any other material (for any purpose, including without limitation, for humorous or satirical effect), as you determine in your sole discretion. Further, I grant Producer the right to attach commercial sponsors to my Submission, my Appearance and any Program in which such Submission or Appearance (or any portion thereof) is included.
3. I acknowledge that the use of my Submission in advertisements or promotions of the Program constitutes part of my Appearance services and that I shall not be entitled to any compensation for such.
4. I hereby release Producer, its successors, assignees, licensees and affiliated entities from any and all claims and demands arising out of or in connection with the uses of my Appearance or the Submission, including, without limitation, any and all liability arising out of Producer's taping and/or recording of me, my voice, image, likeness and use thereof, any and all claims for invasion of privacy, infringement of rights of publicity, defamation (including libel and slander) and any other personal or property right, including personal injury. I agree that I shall not now or in the future assert or maintain any such claim against Producer, its successors, assignees, licensees or affiliated entities.
5. Before appearing on the Program, I have been advised of the Program format and I have no objections to such format.
6. I represent and warrant that I am not a member of any collective bargaining organization, including, but not limited to, the Screen Actors Guild and the American Federation of Television and Radio Artists, that I have the full right, power, and authority to enter into this Agreement, and that I have not accepted and will not accept any money or other compensation from any third party to mention any person, product, service, trademark or brand name, as part of my appearance on the Program.
7. This Appearance Release shall be governed by the laws of the State of California and the State and Federal Courts located in the County of Los Angeles, California shall have exclusive jurisdiction over any disputes arising from or related to this Agreement. I agree to submit to the jurisdiction of the State and Federal Courts of California in the event of any claims arising from or related to this Appearance Release.
8. I understand that Producer has been induced to proceed with the production, distribution and exploitation of my Appearance in reliance on this agreement, but nothing herein shall obligate me to render an Appearance. Further, I have not been induced to enter into this Appearance Release by any representation or promise not contained herein. I have read this Appearance Release prior to signing it and I understand its contents.
