Agency upholds Penn St. refusal to release records

Penn State University has won a round in its refusal to release records of a campus police investigation involving a former assistant football coach accused of molesting boys.

The state Office of Open Records ruled Thursday that Penn State doesn't have to release any records of the 1998 inquiry involving Jerry Sandusky.

The agency ruled on a request filed by ESPN after the university had sought to withhold records. It says the university isn't a state agency and thus is exempt from most provisions of the state Right-to-Know Law. It says the university is required to release only certain financial records.

Sandusky faces dozens of charges stemming from what authorities say were assaults on 10 boys in his home, on Penn State property and elsewhere for 15 years. He and his wife say he's innocent.
